    As you neither asked for nor received permission to use the Work as the basis for [name of infringing work] nor to make or distribute copies, including electronic copies, of same, I believe you have willfully infringed my rights under 17 U.S.C. Section 101 et seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504(c)(2) therein.

    I wrote him, and the website, they haven't made time to answer a plagiarism complaint yet.

    It seem like "Gangster At Heart" attracts plagiarist. I have mixed feelings about the poem now. :(

    Plagiarised "He Don't Even Notice" a poem I wrote from my little niece's point-of-view.
    and he also had stolen "Little Girl Sue"

    I wrote the webmaster, and he wrote back immedietely, and deleted the poem, even apologized.
    Yay! one victory! My hopes are high again.

    wow i couldn't actully beilve how many people are passing this poem off as there own. Makes me sick really how there not even saying "i'm sorry".

    Ya, some people have no confidence in themselves to write thier own poems.

    OMG that is so sad! That is why I was afraid to have my Poems on the internet. My mom was always suggesting I enter them into contests on the Websites, but I was afraid that they would just steal my Poems. I feel really bad for you, and I hope that you get more victories. People who are to dumb to write their own Poems, should be sued or something. Lol. Get a Creative Mind of your own people! Sorry if we are intelligent enough to write our own Poetry, and people actually like it! I hope that people stop stealing your Poems. Maybe there should be a No-Right Click thingy on here. But we shouldn't HAVE to do that so people won't steal, but maybe it'll have to happen someday. I have to go now.

    One reason I decided to go with my whole real name, as opposed to a nick name or symbols, is because of this palgiarism problem. It's easier to prove that a poem is indeed yours with your real name. No disrespect to those who are using nicks. I understand your need for privacy.
    I would like to hear other authors thoughts on this.

    its funny because that locoburrito guy is really hypocritical. He had like a paragraph on his page about how he hates it when people steal pcitures and poems off of his page. He is all talking about taking those people to court, I want to write to him to call him on it but i am sure he has heard a lot from a lot of peolple by now

    Here are tips on protecting your work.

    1) Don't delete your poetry, this website and many others hold and register the time you posted the poem. Proof of when you wrote it.

    2) Use your own name for your important poems. It's easy top prove that my name is David Velazquez, but it would be pretty hard to prove that my name is CurlyFries, Green Eyes, or some crazy symbols. (with all due respect for those who prefer these styles)

    3) If you are really serious about your work, send a self addressed stamped envelope of your work, dont open it, and save it somewhere safe.
    or register it with the Copyright office.

    Someone named joe, from this site is stealing poems off people, for example, "Life of the Dragon" by me, was renamed "The Life Of The Fairie". Others have also been reported including one by Unseen Exposure

    I'm sorry to hear that.

    I have posted a cease and desist letter on his comment section. I hope he realizes what he did is against the rules. He is 12, so maybe he made a mistake... or two.

    Hi David you posted comments on your poem "Gangster at Heart" well i typed it into the search engine on this website to have a read (its good btw) and the same poem came up twice one by you and another exactly the same by Shygirl60218 the only difference is hers was posted on the 10/04/2003. i dont know whether you re-posted it or what but it looks bad on your behalf due to the fact that yours is dated some time afterwards. Im not accusing you of anything just wanted to let you and give you the chance to clear it up for me. thanks.

    "Gangter At Heart" was posted when I first joined this site Aug 28 2003. It even went to the number one spot. I removed it along with the rest of my poems when I left the site. Came back, and reposted all of my poems.
    In realiality there is no way to prove whether its is mine or not.. you will just have to look at the writing tecnique, or ask one of the older members. Or Janis even.

    AS you may allready know, 3 of my poems have been stolen by Hailie (Fate of a Dreamer, which she won a contest with, Lady of the night and the crossroads) and one has been stolen by someone named Lee on this site (Fate of a dreamer).

    Wow...The Fate of a Dreamer has actually been stolen by 4 different people now...One had made it into a song...another was from Kambodia..or something....I may have called them some quite nasty things when I found out...Thats the way it is=)...

    I'm starting to take it as a compliment now...Lol

    I feel that this thread has to be er.. revived.

    Sorry. The cease and desist letter is pretty good.

    If it was a mistake to revive it.. please delete the thread with my apologies, and take the proper procedures.. you know points, lock, delete, ban
    ... and I won't do it again.
