Will you be arrested if you are ONLY high? To make this clearer...if an officer or some type of authority notices your eyes blood shot and everything, and you take a drug test and it tests positive for drugs, will you be arrested for being high? And that you didn't possess the drugs. This is for the USA....or is there different laws in each state for this?

I know that if a cop sees an underage person smocking tobbaco, they can't do anything. But I'm almost positive that you can definatly get arrested for being high.

In California minors under 18 are subject to arrest for tobacco violations. And such arrests DO occur.

i live in texas and for cigs, they dont arrest you for smoking underage(unless hes a ass) but they will for buying them...and if you are caught high...if its obvious like they can actually smell it on you and stuff, they can arrest you but they try to bust the ones who have shit on them...

The reason why I asked this is because I came to school high today, but I did also have the drug in my possession...I got suspended for 10 days and arrested. They want me to take drug tests. I don't know why the drug tests matter. My brother told me you can't be arrested if you are only high...but you can be if you possess the drug. But I learned my lesson...bringing drugs to school when there are like millions of cameras arond, is not a smart thing.

I live in bc canada (Bc bud kicks ass) and here they cant do shit if your high. they cant even do anything if you have anything under 10 grahms on you or something like that.
